Welcome to StudyCards AI (the "App"), operated by Jan Hamsch und Kai Hamsch GbR ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using StudyCards AI, you agree to these Terms. If you do not agree, please refrain from using the App.

StudyCards AI is a mobile application that enables users to create flashcards for learning purposes. Users can generate flashcards by entering text or uploading images, which are then processed by artificial intelligence (Google Gemini) to automatically create study cards. The App offers two subscription tiers: a Free plan with basic features (without AI generation) and a Premium plan (monthly or yearly) with AI-powered flashcard generation and access to all features.
By using StudyCards AI, you confirm your acceptance of these Terms and our Privacy Policy. These Terms form a binding agreement between you and us.

You are responsible for keeping your account credentials secure and for all activities under your account.
You may optionally add a profile picture to personalize your account.
StudyCards AI uses Google Gemini AI technology to process your text inputs or images and generate flashcards automatically. The AI analyzes your content and creates question-answer pairs suitable for learning.
While we strive to provide accurate AI-generated content, we do not guarantee the correctness, completeness, or suitability of the generated flashcards. You are responsible for reviewing and verifying the accuracy of all AI-generated content before using it for studying.
You retain ownership of the text and images you provide to the App. The AI-generated flashcards created from your content are also yours to use for personal learning purposes.
StudyCards AI offers two tiers:
The prices and features of the various subscription plans are displayed in the App and may change from time to time.
Payments are processed via the Apple App Store or Google Play Store platforms, depending on your device, and are subject to their terms and conditions.
Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle ends.
Prices include applicable taxes (e.g., VAT).
Per German law, you may have a 14-day withdrawal right for initial subscriptions. For In-App Purchases, including subscriptions, the withdrawal right can be exercised through Apple's refund process at reportaproblem.apple.com or Google.
You can cancel your subscription at any time. The cancellation becomes effective at the end of the current billing cycle. You retain access to Premium features until the end of the already paid period.
No refunds are provided for unused subscription periods, except where required by law.
For In-App Purchases, please contact Apple through reportaproblem.apple.com or Google to request a refund within the applicable time frame.
We grant you a non-exclusive, non-transferable, revocable license to use StudyCards AI for personal, non-commercial purposes, subject to these Terms.
You retain ownership of all content you create or upload in the App, including text inputs, images, and the resulting flashcards. You grant us a worldwide, royalty-free, non-exclusive license to use, store, and process your content as needed to provide the App's services, including AI processing.
You must not upload illegal, infringing, or harmful content, including but not limited to nudity, violence, hate speech, or anything illegal under German law.
We may remove such content without notice.
You guarantee that the uploaded content does not violate third-party intellectual property rights and that you have the necessary rights to grant us the license as described above.
StudyCards AI, including its code, design, and all features, is owned by Jan Hamsch und Kai Hamsch GbR or our licensors.
You may not reproduce, modify, or distribute the App without permission.
You may not:
StudyCards AI relies on third-party services, including Google Gemini for AI processing. We are not liable for their performance or outages.
Third-party terms and privacy policies apply to their use.
Your data is handled per our Privacy Policy, which complies with GDPR and other applicable laws.
Your text and image inputs may be processed by Google Gemini AI to generate flashcards. Please refer to our Privacy Policy for details on how your data is handled.
We may update StudyCards AI or these Terms at any time. Updates will be posted with a revised "Last Updated" date.
Continued use of the App after changes constitutes acceptance of the new Terms.
We may suspend or terminate your access for violating these Terms or at our discretion, with or without notice.
Upon termination, you lose access to all App features and Premium benefits. Your flashcards and account data may be deleted.
StudyCards AI is provided "as is" without warranties, express or implied, including fitness for a particular purpose.
We do not guarantee the availability, accuracy, or reliability of the App, its features, or the AI-generated content.
AI-generated flashcards may contain errors or inaccuracies. You are responsible for verifying the content before relying on it for studying or any other purpose.
We are not liable for indirect, incidental, or consequential damages (e.g., data loss, incorrect study material) to the fullest extent permitted by law.
Our liability is limited to amounts paid by you in the prior 12 months.
You agree to indemnify us against claims arising from your use of StudyCards AI or violation of these Terms.
These Terms are governed by German law, excluding conflict of law rules.
Disputes shall be resolved in the courts of Freiburg, Germany, unless consumer protection laws dictate otherwise.
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, server outages, AI service disruptions).
If any provision of these Terms is invalid, the remaining provisions remain enforceable.
These Terms, along with the Privacy Policy, constitute the full agreement between you and us.
Our failure to enforce any right does not waive that right.
You may not assign these Terms without our consent. We may assign them freely.
