Welcome to Hazelnote (the "App"), operated by Jan Hamsch und Kai Hamsch GbR ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using Hazelnote, you agree to these Terms. If you do not agree, please refrain from using the App.

Hazelnote is a mobile application that turns study material into structured notes and then into ways of revising it. You provide the source and the App does the rest:
From the resulting note the App generates quizzes and flashcards, translates notes, offers a chat that answers using your own notes, and provides learn games built from your quizzes and flashcards. Notes can be organised into folders.
On the Pro plan the App additionally offers a voice tutor, a spoken conversation about your own notes, and audio summaries, which turn a note into a short episode you can listen to. Both are described in section 6.
The App also contains notebooks and whiteboards for handwriting, drawing and annotating imported PDFs and images, and templates: page layouts you can save, share with others as a file, import, or take from the template marketplace we provide. On a paid plan, notebooks and notes are synchronised across your devices.
The App also offers a Focus Lock. You choose apps on your own device, and once you have used them for a length of time you set yourself, the App asks you a few questions from a note you chose before those apps open again. It is described in section 6.6.
Which of these features are available to you depends on your plan (Free, Essential or Pro), as described in section 7.1. A free trial may be offered before the first payment of a paid plan; its length is shown in the App before you subscribe.
By using Hazelnote, you confirm your acceptance of these Terms and our Privacy Policy. These Terms form a binding agreement between you and us.

You need an account to use the App. Features beyond the Free plan additionally require an active subscription to the plan that includes them (section 7.1).
You are responsible for keeping your account credentials secure and for all activities under your account.
You may optionally add a profile picture to personalize your account.
You can delete your account at any time in the App under Settings, or on our website. Deleting it removes your account and the content stored with it on our servers. An active subscription is not cancelled by deleting the account: subscriptions are managed by Apple or Google and must be cancelled there (section 7.4).
The material you provide is sent to an AI provider acting on our instructions, which produces your results. We currently use OpenAI, the company behind ChatGPT, for all AI features: to write notes, quiz questions, flashcards, translations and chat answers, the questions asked by the Focus Lock, to transcribe audio recordings into text, to hold the spoken conversation of the voice tutor, and to write and speak audio summaries.
We use OpenAI through its interface for business customers, not through ChatGPT itself. OpenAI processes your material only to produce your result and, under its terms for business customers, does not use it to train its models. We may change providers or models where doing so improves the service; the current list is kept here and in our Privacy Policy.
AI-generated content can be wrong. Notes may omit or misstate something, transcripts may mishear a word, quiz answers may be incorrect, translations may be inaccurate, and the chat, the voice tutor and audio summaries can be mistaken about your own material or add explanations that go beyond it. We do not guarantee the correctness, completeness or suitability of anything the App produces, and it is not a substitute for the source it was made from. Check anything that matters against the original, particularly before an examination. Nothing the App produces is medical, legal, financial or other professional advice.
You retain ownership of everything you provide: recordings, files, links, photographs, handwriting and text. The notes, quizzes, flashcards, translations and audio summaries created from it are yours to use for your own learning.
You may only provide material you are permitted to use. Recording a lecture, a lesson or any conversation may require the consent of the people involved, and the rules differ by country and institution. Obtaining that consent is your responsibility, not ours. The same applies to copyrighted documents and to material containing other people's personal information.
Every generation costs us money, so each account with a plan that includes AI features has an allowance, counted over a rolling month and, depending on the plan, a rolling week. Notes, quizzes, flashcards, translations, the chat, the voice tutor, audio summaries and the questions of the Focus Lock all draw on the same allowance. The size of the allowance depends on your plan and on whether you hold an AI Pass (section 7.1). The Essential allowance is deliberately small and meant for trying the AI features; the Free plan includes no AI features. Normal study use on Pro stays well inside it. Heavy use may be answered more economically, and in the rare case that the allowance is exhausted, generation is paused until the period rolls over. Reading, revising and playing with what you have already made is never limited.
The allowance is not a fixed quantity, and we may change it at any time at our discretion. Your subscription gives you access to the App and its features, not a guaranteed number of generations. We may raise the allowance, reduce it, change how it is divided across a week or a month, change which features draw on it, and change how heavy use is answered once the allowance is reached. We do this to keep pace with what the underlying AI models cost us, which is outside our control and changes often.
A change takes effect when we make it and applies to the allowance from that point onwards. It never affects the notes, quizzes, flashcards or games you have already created: those remain yours and remain fully usable, as set out in section 6.3. The allowance in force at any given time, and when it next refills, is shown in the App under Settings. If we reduce it and you are no longer happy with the subscription, you can cancel at any time as described in section 7.4.
The Focus Lock is part of the Pro plan. If your plan no longer includes it, it is switched off, so that it never holds your apps shut while you have no way to switch it off in the App.
The Focus Lock is a tool you point at yourself. You choose which apps it applies to, how long you may use them before it asks, and which of your notes the questions come from. Nothing is chosen for you and it is off until you switch it on.
It is friction, not a padlock, and it is not a safety feature. You can switch it off in the App at any time, and you can switch it off in your device's own settings without the App being involved. Do not rely on it to keep you, or anyone else, away from anything that matters. It is not parental control software and must not be used to restrict another person's device.
It depends on features your operating system provides, and those features are outside our control. Apple and Google may change or withdraw them, your device may not support them, and a permission you decline or later revoke will stop the lock working. We therefore cannot promise that the Focus Lock will run on a given device, that it will block a given app, or that it will not occasionally let an app through. If it cannot ask you a question, it lets you through by design rather than holding your apps shut.
Generating the questions uses your AI allowance under section 6.5, exactly as creating a quiz yourself does. The one exception is the welcome note every account starts with, whose questions are built into the App and cost nothing.
On the Essential and Pro plans, your notebooks, whiteboards and the files you import into them are stored on our servers so that they can be synchronised across your devices. We do not advertise a fixed storage quota, and normal study use is not limited. Each plan does limit the size of a single imported file, as shown in the App. On the Free plan, notebooks are stored only on your device and are not synchronised; if you lose the device or delete the App, they cannot be recovered by us.
Storage on our servers is subject to fair use. Storing data costs us money for as long as it is kept, and those costs are outside our control. Where an account stores an amount that is clearly out of proportion to ordinary study use, we may contact you and may limit further uploads to that account, for example by asking you to move to a plan that includes more capacity. Such a limit never deletes or blocks access to anything already stored: your existing notebooks remain yours and remain fully usable.
The voice tutor is part of the Pro plan. While a session runs, your voice is streamed from your device directly to OpenAI and answered in real time; the tutor can open your notes when you ask about them. We do not store a recording or a transcript of the conversation. Each session is limited in length, as shown in the App, and the time used draws on your AI allowance. The tutor explains your material; it is not a teacher, and section 6.2 applies to everything it says.
Audio summaries are part of the Pro plan. The App writes a script from your note and has it spoken by a synthetic voice. The voices are generated by AI and are not the voices of real people. The finished audio is stored with your account so that you can play it again; the number of episodes kept per note is limited, as shown in the App.
Templates in our marketplace are provided by us for use in your own notebooks. You may use pages made from them freely for your own learning, but you may not sell or redistribute the templates themselves. We may add, change or remove marketplace templates at any time. Using a template copies it into your notebook, so a later change to the template never changes a page you have already made.
Templates you create and share as a file are your content under section 9. Only share templates you have the right to share, and only open template files from people you trust.
Hazelnote is offered in three plans:
The exact limits of each plan are shown in the App before you subscribe and in the plan comparison.
In addition, holders of Essential or Pro may subscribe to an AI Pass, a separate monthly subscription that raises the AI allowance under section 6.5 from the moment it is active. It does not unlock features that are not part of your plan, it does not reset an allowance already used, and it gives no AI access on its own: if your Essential or Pro subscription ends, the AI Pass has no effect until you subscribe to a plan again. Because it is a separate subscription, it must be cancelled separately.
Subscriptions are offered for different periods, currently weekly, monthly and yearly, and not every period is offered for every plan. Which periods are shown to you, the limits of each plan and the price may vary and are always displayed in the App before you subscribe.
A free trial may be offered before the first payment. Whether there is one, and how long it is, is shown in the App before you subscribe. A trial is available only once per store account. If you do not cancel before the trial ends, the subscription begins and is charged.
A discounted first period may be offered; after it the subscription renews at the regular price shown when you subscribed.
The prices and features of the various subscription plans are displayed in the App and may change from time to time.
You can change between Essential and Pro and between billing periods in the App. How the change is charged, and whether it takes effect immediately or at the end of the current period, is decided by Apple or Google and shown in their confirmation.
If a paid plan ends, your account falls back to the Free plan. Nothing you have created is deleted because of this: existing notebooks, whiteboards, folders and notes remain yours and can still be opened. You can no longer create more than the Free plan allows, use features your plan no longer includes, or synchronise until you subscribe again. Changes made while synchronisation is paused are kept on your device and uploaded once it resumes.
Promotional and offer codes are redeemed through Apple or Google and are subject to their terms.
Payments are processed via the Apple App Store or Google Play Store platforms, depending on your device, and are subject to their terms and conditions.
Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle ends. A subscription is tied to the Apple or Google account it was bought with; access is granted to the Hazelnote account that was signed in when it was bought or restored.
Prices include applicable taxes (e.g., VAT).
Per German law, you may have a 14-day withdrawal right for initial subscriptions. For In-App Purchases, including subscriptions, the withdrawal right can be exercised through Apple's refund process at reportaproblem.apple.com or Google.
You can cancel your subscription at any time, in the App under Settings, Manage subscription, or in the subscription settings of your Apple or Google account. The cancellation becomes effective at the end of the current billing cycle. You retain access to your plan until the end of the period you have already paid for. Deleting the App or your account does not cancel a subscription.
No refunds are provided for unused subscription periods, except where required by law.
For In-App Purchases, please contact Apple through reportaproblem.apple.com or Google to request a refund within the applicable time frame.
We grant you a non-exclusive, non-transferable, revocable license to use Hazelnote for personal, non-commercial purposes, subject to these Terms.
You retain ownership of all content you create or upload in the App: recordings, documents, links, photographs, handwriting, templates and text, and the notes, quizzes, flashcards, translations and audio summaries made from them. You grant us a worldwide, royalty-free, non-exclusive license to use, store, and process your content as needed to provide the App's services, including AI processing.
You must not upload illegal, infringing, or harmful content, including but not limited to nudity, violence, hate speech, or anything illegal under German law.
We may remove such content without notice.
You guarantee that the uploaded content does not violate third-party intellectual property rights and that you have the necessary rights to grant us the license as described above.
Feedback. If you send us feedback, feature wishes, a rating or a problem report, we may use it to improve Hazelnote without any obligation to you. A problem report includes technical information about the error, such as error messages from the App and details of your device, so that we can find the cause.
Hazelnote, including its code, design, and all features, is owned by Jan Hamsch und Kai Hamsch GbR or our licensors.
You may not reproduce, modify, or distribute the App without permission.
You may not:
Hazelnote depends on services we do not run: OpenAI for the AI, Google Firebase for hosting and storage, RevenueCat for subscriptions, and Apple and Google for payments and their app stores. We are not liable for their performance or outages.
Third-party terms and privacy policies apply to their use.
Your data is handled per our Privacy Policy, which complies with GDPR and other applicable laws.
Your account, your notes and your uploaded files are stored in the European Union. The AI processing itself is carried out by OpenAI in the United States: the material you provide, your recordings and everything made from them are sent there to be processed, and the voice tutor streams your voice directly to OpenAI. Our Privacy Policy sets out exactly what is sent where, and on what legal basis.
We may update Hazelnote or these Terms at any time. Updates will be posted with a revised "Last Updated" date.
Continued use of the App after changes constitutes acceptance of the new Terms.
We may suspend or terminate your access for violating these Terms or at our discretion, with or without notice.
Upon termination, you lose access to all App features. Your notes, recordings and account data may be deleted. Where we terminate for reasons other than a breach of these Terms, we will give you reasonable notice so that you can export your content first.
Hazelnote is provided "as is" without warranties, express or implied, including fitness for a particular purpose.
We do not guarantee the availability, accuracy, or reliability of the App, its features, or the AI-generated content.
Everything the App generates may contain errors: notes, transcripts, quizzes, flashcards, learn games and chat answers alike. You are responsible for verifying the content before relying on it for studying or any other purpose.
We are not liable for indirect, incidental, or consequential damages (e.g., data loss, incorrect study material) to the fullest extent permitted by law.
Our liability is limited to amounts paid by you in the prior 12 months.
These limitations do not apply to liability for intent or gross negligence, for injury to life, body or health, under the German Product Liability Act, or for the breach of essential contractual obligations, where liability is limited to the foreseeable damage typical for this kind of contract. Mandatory consumer protection law remains unaffected.
You agree to indemnify us against claims arising from your use of Hazelnote or violation of these Terms.
These Terms are governed by German law, excluding conflict of law rules.
Disputes shall be resolved in the courts of Freiburg, Germany, unless consumer protection laws dictate otherwise.
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, server outages, AI service disruptions).
If any provision of these Terms is invalid, the remaining provisions remain enforceable.
These Terms, along with the Privacy Policy, constitute the full agreement between you and us.
Our failure to enforce any right does not waive that right.
You may not assign these Terms without our consent. We may assign them freely.
We send notices to the email address on your account, or through the App. You can reach us at hello@fade.de.
