Welcome to Hazelnote (the "App"), operated by Jan Hamsch und Kai Hamsch GbR ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of the App and its services. By downloading, installing, or using Hazelnote, you agree to these Terms. If you do not agree, please refrain from using the App.

Hazelnote is a mobile application that turns study material into structured notes and then into ways of revising it. You provide the source and the App does the rest:
From the resulting note the App generates quizzes and flashcards, offers a chat that answers using your own notes and nothing else, and provides learn games built from your material. Notes can be organised into folders and are synchronised across your devices.
The App also offers a Focus Lock. You choose apps on your own device, and once you have used them for a length of time you set yourself, the App asks you a few questions from a note you chose before those apps open again. It is described in section 6.6.
Every one of these features requires an active subscription. There is no free tier. A free trial may be offered before the first payment; its length is shown in the App before you subscribe.
By using Hazelnote, you confirm your acceptance of these Terms and our Privacy Policy. These Terms form a binding agreement between you and us.

You need an account and an active subscription to use the App. Both are required for every feature; nothing works without them.
You are responsible for keeping your account credentials secure and for all activities under your account.
You may optionally add a profile picture to personalize your account.
The material you provide is sent to AI providers acting on our instructions, which produce the note, the quiz, the flashcards, the learn games and the chat answers. We currently use:
These providers process your material only to produce your result. We may change providers where doing so improves the service; the current list is kept here and in our Privacy Policy.
AI-generated content can be wrong. Notes may omit or misstate something, transcripts may mishear a word, quiz answers may be incorrect, and the chat can be mistaken about your own material. We do not guarantee the correctness, completeness or suitability of anything the App produces, and it is not a substitute for the source it was made from. Check anything that matters against the original, particularly before an examination.
You retain ownership of everything you provide: recordings, files, links, photographs and text. The notes, quizzes, flashcards and games created from it are yours to use for your own learning.
You may only provide material you are permitted to use. Recording a lecture, a lesson or any conversation may require the consent of the people involved, and the rules differ by country and institution. Obtaining that consent is your responsibility, not ours. The same applies to copyrighted documents and to material containing other people's personal information.
Every generation costs us money, so each account has a monthly allowance. Normal study use stays well inside it. Heavy use may be answered more economically, and in the rare case that the allowance is exhausted, generation is paused until the next period. Reading, revising and playing with what you have already made is never limited.
The Focus Lock is a tool you point at yourself. You choose which apps it applies to, how long you may use them before it asks, and which of your notes the questions come from. Nothing is chosen for you and it is off until you switch it on.
It is friction, not a padlock, and it is not a safety feature. You can switch it off in the App at any time, and you can switch it off in your device's own settings without the App being involved. Do not rely on it to keep you, or anyone else, away from anything that matters. It is not parental control software and must not be used to restrict another person's device.
It depends on features your operating system provides, and those features are outside our control. Apple and Google may change or withdraw them, your device may not support them, and a permission you decline or later revoke will stop the lock working. We therefore cannot promise that the Focus Lock will run on a given device, that it will block a given app, or that it will not occasionally let an app through. If it cannot ask you a question, it lets you through by design rather than holding your apps shut.
Generating the questions uses your AI allowance under section 6.5, exactly as creating a quiz yourself does. The one exception is the welcome note every account starts with, whose questions are built into the App and cost nothing.
Hazelnote is available by subscription only. There is no free tier. Subscriptions are offered for different periods, currently weekly, monthly and yearly; which are shown to you, and at what price, may vary and is always displayed in the App before you subscribe.
A free trial may be offered before the first payment. If you do not cancel before the trial ends, the subscription begins and is charged.
The prices and features of the various subscription plans are displayed in the App and may change from time to time.
Payments are processed via the Apple App Store or Google Play Store platforms, depending on your device, and are subject to their terms and conditions.
Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle ends.
Prices include applicable taxes (e.g., VAT).
Per German law, you may have a 14-day withdrawal right for initial subscriptions. For In-App Purchases, including subscriptions, the withdrawal right can be exercised through Apple's refund process at reportaproblem.apple.com or Google.
You can cancel your subscription at any time. The cancellation becomes effective at the end of the current billing cycle. You retain access to the App until the end of the period you have already paid for.
No refunds are provided for unused subscription periods, except where required by law.
For In-App Purchases, please contact Apple through reportaproblem.apple.com or Google to request a refund within the applicable time frame.
We grant you a non-exclusive, non-transferable, revocable license to use Hazelnote for personal, non-commercial purposes, subject to these Terms.
You retain ownership of all content you create or upload in the App: recordings, documents, links, photographs and text, and the notes, quizzes, flashcards and learn games made from them. You grant us a worldwide, royalty-free, non-exclusive license to use, store, and process your content as needed to provide the App's services, including AI processing.
You must not upload illegal, infringing, or harmful content, including but not limited to nudity, violence, hate speech, or anything illegal under German law.
We may remove such content without notice.
You guarantee that the uploaded content does not violate third-party intellectual property rights and that you have the necessary rights to grant us the license as described above.
Hazelnote, including its code, design, and all features, is owned by Jan Hamsch und Kai Hamsch GbR or our licensors.
You may not reproduce, modify, or distribute the App without permission.
You may not:
Hazelnote depends on services we do not run: Anthropic and OpenAI for the AI, Google Firebase for hosting and storage, and RevenueCat for subscriptions. We are not liable for their performance or outages.
Third-party terms and privacy policies apply to their use.
Your data is handled per our Privacy Policy, which complies with GDPR and other applicable laws.
Your account, your notes and your uploaded files are stored in the European Union. The AI processing itself happens in the United States: recordings go to OpenAI to be transcribed, and their text goes to Anthropic to be turned into notes and everything made from them. Our Privacy Policy sets out exactly what is sent where, and on what legal basis.
We may update Hazelnote or these Terms at any time. Updates will be posted with a revised "Last Updated" date.
Continued use of the App after changes constitutes acceptance of the new Terms.
We may suspend or terminate your access for violating these Terms or at our discretion, with or without notice.
Upon termination, you lose access to all App features. Your notes, recordings and account data may be deleted.
Hazelnote is provided "as is" without warranties, express or implied, including fitness for a particular purpose.
We do not guarantee the availability, accuracy, or reliability of the App, its features, or the AI-generated content.
Everything the App generates may contain errors: notes, transcripts, quizzes, flashcards, learn games and chat answers alike. You are responsible for verifying the content before relying on it for studying or any other purpose.
We are not liable for indirect, incidental, or consequential damages (e.g., data loss, incorrect study material) to the fullest extent permitted by law.
Our liability is limited to amounts paid by you in the prior 12 months.
You agree to indemnify us against claims arising from your use of Hazelnote or violation of these Terms.
These Terms are governed by German law, excluding conflict of law rules.
Disputes shall be resolved in the courts of Freiburg, Germany, unless consumer protection laws dictate otherwise.
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, server outages, AI service disruptions).
If any provision of these Terms is invalid, the remaining provisions remain enforceable.
These Terms, along with the Privacy Policy, constitute the full agreement between you and us.
Our failure to enforce any right does not waive that right.
You may not assign these Terms without our consent. We may assign them freely.
